Please take a moment to read the following terms and conditions, which apply to all orders and purchases.
The following terms and conditions apply to any purchases of art supplies and/or other products that you (“Customer”) make from us, Montana Colors Australia. By ordering products or by accepting delivery of products ordered, you accept and agree to be bound by these terms and conditions. Montana Colors Australia. reserves the right to modify or change these terms and conditions at any time without notice.
PRICES, SHIPPING, HANDLING AND TAXES
Prices do not include charges for shipping and handling. Product prices found on the site are displayed including GST.
SHIPPING & HANDLING
Delivery Charges will vary greatly, depending on where in Australia you reside.
It is your obligation to enter the correct delivery address details at the time of ordering. Please note that Montana Colors Australia. is unable to deliver spray paint to a P.O. Box. Should you enter the wrong address, we are not obligated to re-send the order to the correct address at our expense.
Whilst we make every effort to dispatch all orders in a timely manner, we cannot be held responsible for third party/courier company failures. Please contact us at australia@montanacolors.com or on 02 9550 5997 if you are experiencing delays with your order.
Montana Colors Australia is unable to process orders or dispatch deliveries on weekends and public holidays.
We will not be held liable for any loss or damage resulting from late delivery, including missing job/project deadlines. You have the option to have your item delivered with or without a signature of receipt. If you choose to have the item delivered without a signature of receipt you are liable for actions thereafter the couriers said delivery. If you choose to sign for your item you will generally need to be available between 8.30am and 5pm to receipt the delivery.
As soon as your order is dispatched we will send you an email shipping confirmation with a tracking number and a link to the carrier’s site. Please note the number will not be traceable for at least 24 hours. Please allow at least 24 hours for your tracking number to be in our carrier’s systems.
VALID IDENTIFICATION
It is illegal under Australian Law for us to sell or supply spray paint to minors. By accepting our terms and conditions upon completing your order at our checkout, you are agreeing that you are over the age of 18 and that at the time of delivery we are supplying the goods to persons over the age of 18. If you are not over the age of 18 and you attempt to purchase goods from our website we can refuse to sell goods to you.
PAYMENT
Payments can be made by credit card unless otherwise indicated on our website, and must be received by Montana Colors Australia prior to processing and shipment of the order. We accept Visa, Mastercard, Paypal and Bank transfer. We do not accept cash or American Express. We cannot accept credit cards with billing addresses outside of Australia.
Montana Colors Australia. validates your credit card by checking your personal billing information, and thus we require you to enter the billing information as it appears on your credit card statement before we authorize your purchase. We charge your credit card before we ship the item.
Limitation of Liability
Customer’s sole remedy for any breach of these terms and conditions by Montana Colors Australia. shall be a refund of the purchase price paid. Montana Colors Australia.’s total, aggregate liability shall not, in any event, exceed the total amount paid by the customer for any products purchased hereunder. In no event shall Montana Colors Australia. be liable for any consequential, special, indirect, or punitive damages, including any lost profits or loss of business, or for any claim by any third party, even if advised of the possibility of such damages or claims.
MISCELLANEOUS
Policies, item availability, and prices are subject to change without notice. Products purchased from Montana Colors Australia. are only for personal use and are not for resale unless, the proper
documentation is provided by Customer in the form of a certificate of resale. Wholesale products are not for gift giving or personal use. Montana Colors Australia. reserves the right to terminate any distributor account found to be violating this agreement. These terms and conditions and any orders or purchases from this web site, shall be governed by the laws of the state of New South Wales.
